📜 TERMS OF USE

1. GENERAL PROVISIONS AND ACCEPTANCE

These Terms of Use ("Terms") govern your use of the Sormalı mobile application ("App", "Platform").

✅ Declaration of Acceptance:

By downloading, installing or using this app, you declare that you have:

• Read these Terms
• Understood them
• Accepted them
• And undertake to comply with them.

❌ If You Do Not Accept:

If you do not accept these Terms, do not use the app and delete it immediately.

2. ACCOUNT CREATION REQUIREMENTS

📝 Eligibility Criteria:

• You must be over 18 (mandatory)
• You must use your real identity
• You must provide accurate and up-to-date information
• Each person may open only 1 account
• You must be subject to the laws of the Republic of Türkiye

🚫 The Following May Not Open an Account:

• Persons under 18
• Previously banned users
• People using a false identity
• Bots or automated systems

🔐 Account Security:

• You must use a strong password
• You must not share your password with anyone
• You are responsible for the security of your account
• Report any suspicious activity immediately

3. PROHIBITED CONDUCT AND CONTENT

Zero tolerance: Sormalı has zero tolerance for objectionable content and abusive users. Content that breaks the rules in this section is removed; accounts may be suspended or permanently closed without warning. You can report content and users with the in-app "Report" and "Block" options. Serious reports (harassment, threats, child safety) are reviewed within 24 hours at the latest. ⛔ STRICTLY PROHIBITED:

🚫 Fake Profiles and Identity:

• Using someone else's photos
• Giving a false age, name or information
• Impersonating a celebrity or public figure
• Using bots or automated accounts

💰 Commercial Activities:

• Sex work or escort services
• Selling drugs, weapons or illegal substances
• MLM or pyramid schemes
• Sending advertising or spam

😡 Harassment and Abuse:

• Sexual harassment or disturbing messages
• Threats, insults, profanity
• Stalking (following, harassing)
• Bullying or discrimination

📸 Illegal Content:

• Nudity or pornographic content
• Violent images
• Child abuse (reports are forwarded to the police immediately!)
• Copyright infringement
• Hate speech

🎭 Deception and Fraud:

• Asking for money or gifts
• Phishing or fraud
• Asking for credit card/bank details
• Promising investments or earnings

4. CONTENT OWNERSHIP AND LICENSE

📸 Your Content:

• You own the photos, videos and texts you upload
• However, you grant Sormalı the following rights:
• The right to display your content on the platform
• The right to share it with other users
• The right to process and optimize it (compression, resizing, etc.)
• The right to moderate and review it

This license is free of charge, worldwide and irrevocable.

When you delete your account, your content is deleted as well.

🎨 Sormalı's Content:

• The app design, logo and code are the property of Sormalı
• The question database and algorithms are protected by copyright
• Reverse engineering and copying are prohibited
• All rights reserved

5. SUBSCRIPTION, PAYMENT AND REFUND POLICY

💎 Premium Subscription:

Three plans are offered: Basic, Standard and Premium; each can be purchased monthly or yearly. The contents, usage allowances and prices of the plans are shown on the purchase screen in the app; the contents shown on that screen at the time of purchase apply.

All plans include:

• Unlimited likes
• Ad-free experience
• Free boosts every month (Basic 1, Standard 2, Premium 4)
• Increased usage allowances in game modes (Q&A, quick match, nearby, play with a friend, etc.); on the Premium plan these allowances are unlimited

🚀 Boost:

• A boost is a one-time purchase independent of any subscription (5, 15 or 30 minutes)
• During a boost your profile is shown more often to other users in the Discover feed; no specific number of views or matches is guaranteed
• If you buy a new boost while one is active, the time is extended rather than reset

🎁 Free Use:

• The app can be used for free: a certain number of free uses is granted every day, and additional uses can be earned by watching ads

💳 Payment:

• Apple App Store (iOS users)
• Google Play Store (Android users)
• Automatic renewal (you can cancel at any time)

🔄 Cancellation and Refunds:

• Cancellation: You can cancel your subscription at any time in your App Store/Play Store subscription settings; to stop renewal, we recommend cancelling at least 24 hours before the end of the period
• When you cancel, premium continues until the end of the current period
• Refunds: Since payments are collected by Apple or Google, refund requests are also assessed by them under their own policies: for iOS at reportaproblem.apple.com, for Android on the Google Play refund page
• Subscriptions and boosts are digital content credited to your account at the moment of purchase. Therefore Sormalı does not give partial refunds for the remaining time of a subscription cancelled mid-period, and a boost, which starts at the moment of purchase, is not refunded
• If a subscription is refunded by the store, Premium access ends
• If content you purchased was not credited to your account due to a technical problem, write to support@sormali.app; we will verify the purchase record and credit the content or help you with the refund process
• Any rights granted to you by applicable consumer law that cannot be excluded by contract remain unaffected

6. DISCLAIMER AND WARRANTIES

⚠️ Service Warranty:

• The app is provided "as is"
• We do not guarantee uninterrupted operation
• We do not guarantee matches
• We do not guarantee a relationship or marriage

🚫 Sormalı Is Not Responsible For:

• Users' behavior
• Disputes between users
• Incidents during offline meetings
• Financial losses
• Emotional harm or disappointment
• Errors of third-party services (Agora, Google)

⚖️ Limitation of Liability:

• Maximum liability: the subscription fees paid in the last 12 months
• We are not liable for indirect or incidental damages
• We are not liable for damages users cause each other

7. ACCOUNT SUSPENSION AND TERMINATION

🚨 Your Account May Be Closed:

We may suspend or permanently close your account in the following cases:

• If you violate these Terms
• If illegal activity is detected
• If you use a fake profile
• If you harass other users
• If spam or bot activity is detected
• If you receive multiple complaints
• If there are payment issues

⚖️ Process:

• Detection of the violation
• Warning (for minor violations)
• Temporary suspension (1-30 days)
• Permanent closure (serious violations)

📧 Right to Appeal:

• You may appeal an unfair closure

• Review time: 7 days

8. INTELLECTUAL PROPERTY RIGHTS

All content of the Sormalı app (design, logo, code, algorithms, question database) is protected by copyright and intellectual property laws.

🚫 Prohibited:

• Copying the app
• Reverse engineering
• Stealing the source code
• Using it to develop a similar app
• Using the logo or brand name without permission

9. CHANGES TO THE TERMS

Sormalı reserves the right to change these Terms of Use at any time. In-app notifications will be sent for significant changes.

If you continue to use the app after the changes, you are deemed to have accepted the new terms.

10. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Republic of Türkiye.

Consumers residing in Türkiye: Under Consumer Protection Law No. 6502, for disputes within the monetary limits set each year you may apply to the Consumer Arbitration Committee at your place of residence or where the transaction was made, and for disputes above those limits to the Consumer Court.

Users residing outside Türkiye: The choice of law in these Terms does not remove the mandatory consumer protections granted by the law of your place of residence that cannot be waived by contract (e.g. for consumers residing in the European Union). To the extent permitted by applicable law, you may also bring proceedings before the courts of your place of residence.

Without prejudice to the mandatory provisions above, the Courts and Enforcement Offices of Istanbul have jurisdiction over disputes with users who are legally permitted to enter into jurisdiction agreements (merchants and public legal entities).

Before a problem turns into a dispute, we recommend contacting us at support@sormali.app. This recommendation does not limit your rights of recourse described above.

11. SAFETY RULES AND RECOMMENDATIONS

✅ FOR SAFE USE:

• Meet in busy, public places on first dates
• Tell someone where you are
• Do not share personal information (address, bank details, national ID)
• Report people who ask for money or gifts
• Report suspicious behavior immediately
• Do not meet while under the influence of alcohol or drugs

If you feel threatened, harassed or in danger (Türkiye numbers; elsewhere use your local emergency number):

13. FINAL PROVISIONS

• These Terms are the entire agreement and supersede all prior agreements
• The invalidity of any provision does not affect the other provisions
• Sormalı's failure to exercise any right does not constitute a waiver
• These Terms may not be transferred (by the user)
• Sormalı may transfer these Terms in the event of a company merger

14. CONFIRMATION AND ACCEPTANCE

I have read, understood and accept these Terms of Use. I declare that I am over 18 and undertake to comply with these Terms.

By using the app, you are deemed to have confirmed this declaration.
